Garfield Town Board Meeting – Rescheduled due to weather

February 25, 2019

Meeting called to orderby Chairman, Ed Gullickson, at 7:00 pm.

 

Public Comments:  Jason Kjeseth commented on the ice storm and snow storms that the maintenance workers did a good job maintaining the roads.

 

Road Maintenance:  Gullickson stated that the Chevy truck has some major mechanical issues and will have to be dealt with.

 

Impact Fee Determination for Jason Kjeseth and Josh Roos:  Gullickson asked Jason Kjeseth and Roos if they received a letter from the Town’s attorney.  Gullickson addressed Roos as to road work and how it is broken out into operations, maintenance, and construction.  Gullickson also commented on the process of reconstructing/rebuilding a road and which roads have been reconstructed since 2003.  Jason Kjeseth asked when North Bear Lake and South Bear Lake roads were done and requested that he get that information after the meeting (Clerk is not available after meeting due to another meeting already in progress).  Gullickson stated that the years and amounts that were given was for blacktop, gravel, culverts, etc. and did not include labor, equipment, or machine time.  Gullickson also stated the estimate of blacktop for this coming year.  The Impact Fee money since the ordinance was approved in 2007 has been used for road construction, the maintenance building, and the park.  Jason Kjeseth stated that he wanted noted that Gullickson stated that no Impact Fees for 2017 was used on the park or maintenance building.  Mike Kjeseth commented on the state statute regarding impact fees and stated that the Town is not using the fees appropriately and in direct violation.  Gullickson stated that the Board has been advised by it’s attorney and does not want to get into an argument over this matter.  Jason Kjeseth handed out his email to the Town’s attorney and read a portion of it.  Jason Kjeseth stated that 155thstreet was not included on Impact Fee.  Jason Kjeseth stated that his property is a homestead.  Knutson stated that she provided Kjeseth with tax roll assessments stating that the parcel was taxed on land only as far back as County goes (2000) and that there was no improved values.  Gullickson inquired to Kjeseth that he stated he did not get an invoice for the impact fees.  Kjeseth denied that.  Stroebel tried to explain the attorney’s email to Jason Kjeseth in that he was not reading it correctly.  Jason Kjeseth commented on the open meeting law in that he was not given the amount of time to pay his impact fee.  Kjeseth stated where he stands on a existing dwelling.  Gullickson stated that the board is not going to continue debating this matter.  Stroebel tried to relay the legal issued that the Town has followed and that the Board is going to follow the advice of the Town’s attorney.  Gullickson stated that he has information from Town’s attorney and asked the Board if they wanted to that advice.  Stroebel made a motion to follow the Town’s attorney advice and enforce the impact fee on Jason Kjeseth.  Seconded by Gullickson.  Carried-unanimously. 

 

Amend February 2018 Board Minutes:  Gullickson stated that the minutes for the February 2018 Town Board Meeting stated that the fees were applies to road maintenance.  That was documented in error and should have read road construction.  Gullickson/Stroebel made a motion to amend that February 2018 board minutes to read fees were applied to road construction.  Carried-unanimously.  Jason Kjeseth and Josh Roos are in opposition in regard to the minutes being changed.

 

Roads Scheduled for Reconstruction in 2019:  Big Lake Drive, Kennedy Mill, and 130thStreet.  Gullickson has an estimate from Monarch for blacktopping and that amount is a 30% increase.  

 

Tree Maintenance Issues in Garfield Park:  New Richmond Tree Service has been contracted to take a couple of trees down at the park. 

 

Finalize Action for Dog Damage Claim:  Gullickson has received the sheriff’s reports on the dog that did damage and will go to the County for claim.

 

Reset March Board Meeting:  Gullickson will not be available for the March meeting due to a surgery and would like to reschedule the regular board meeting to the 18th.  Gullickson made motion to move the March Board Meeting to the 18that 7:00 pm.  Seconded by Stroebel.  Carried-unanimously.

 

Clerk’s Report:  Submitted and reviewed. 

 

Approval of Vouchers:  Submitted, signed and approved.  Motion made by Stroebel/Mork to approve submitted vouchers.  Carried-unanimously.

 

Treasurer’s Report:  Submitted and reviewed.

 

Approval of Monthly Board Minutes:  Motion made by Stroebel/Gullickson to approve the February 25, 2019, Board minutes as submitted.  Carried-unanimously.  

 

Adjourn:  Motion made by Stroebel/Mork to adjourn meeting, 8:18 pm.  Carried-unanimously.
