Garfield Board of Review Hearing                                   

June 5, 2014 and July 8, 2014

Meeting called to orderby Chairman, Ed Gullickson, at 5:07 pm

Motion made by Stroebel to nominate Gullickson as Chairman.  Seconded by Mork.  Carried-unanimously.

Motion made by Stroebel to nominate Mork as Vice Chairman.  Seconded by Gullickson.  Carried-unanimously.

James & Bonnie Rushfeldt

Property owner Bonnie Rushfeldt and Greg LaFond from Bowmar Appraisal were sworn in by Clerk.  LaFond stated the rules that they have to follow for assessments and the procedures of the Board of Review.

Rushfeldt stated that the land was/is being used for over 150 bee colonies.  The bees are there from May-November and winter in California.  Gullickson asked what classification the land was in and what is now.  LaFond stated that the land was in MFL and now Productive Forest Land.  Apiary inspection reports from 2012, 2011, 2010, 2009, 2008, and 2007 were introduced in the record as undisputed evidence of the presence of bee in commercial quantity.  Board received a letter from Sara Rushfeldt that she has maintained 200 colonies at 750 190th Street, Dresser, WI for 2013.  Rushfeldt asserted a Wisconsin court case established the presence of bees as qualifying land as pasture for classification.  Gullickson asked if Rushfeldt had a court case number in regard to bees being considered farming/pasture land, Rushfeldt did not.  LaFond stated that the land was in MFL until January 1, 2014.  LaFond stated that the statute requires that when land comes out of the MFL program, the land is considered forest land/recreational land.  MFL land cannot be pastured. 

Motion made by Stroebel/Mork to uphold the assessor’s decision.  Carried-unanimously.

McBrayer:  Motion made by Stroebel/Gullickson to adjourn meeting/issue in regards to McBrayer to Tuesday, July 8, 2014, at 7:00 pm for the sole consideration of the McBrayer matter.  Carried-unanimously.

2014 Assessment Roll:  Motion made by ­­­Stroebel/Mork to accept the 2014 Assessment Roll.  Carried-unanimously.

Approval of Board Minutes:  Motion made by Stroebel/Mork to approve the 2014 Board of Review minutes as submitted.  Carried-unanimously.  

Adjourn of June 5, 2014, Board of Review:  Motion made by Gullickson/Mork to adjourn Board of Review on June 5, 2014, at 7:00 pm.  Carried-unanimously.

July 8, 2014, Adjourned Board of Review Hearing Continued.

Adjourned Board of Review Meeting of July 8, 2014, called to orderby Chairman, Ed Gullickson, at 7:00 pm.

McBrayer:  Board of Review is reconvened from June 5, 2014, to hear the appeal of Michael McBrayer, Parcel #24-1152-0.

The Assessor and McBrayer have agreed to the following assessment for 2014: Land $203,700; Improvements $517,900; for a Total of $781,700.

Motion made by Mork/Streobel to accept the assessment of $781,700 for 2014, for McBrayer PIN 24-1152-0.  Carried-unanimously.

Gullickson stated that the business of the 2014 Board of Review is complete.

Approval of Board of Review Minutes:  Motion made by Stroebel/Gullickson to approve the 2014 Board of Review minutes from June 5, 2014, and July 8, 2014.  Carried-unanimously.
