   Town of Garfield - Special Meeting Prospect Avenue Abandonment

October 11, 2017

 

Present:         Chairman:     Ed Gullickson

                        Bob & Lisa Turek-Shay

 

Meeting called to orderby Chairman, Ed Gullickson, at 2:00 pm.

 

Meeting took place on-site at 772 & 774 130thStreet.  Discussion on the road right of way and the line where the proposed abandonment would end.

 

Stroebel stated for clarification that Prospect Avenue is a public right of way and not an easement.  The public have not used it in years.  Gullickson commented that the dispute isn’t the line of abandonment but the right of way behind the rocks.  Turek-Shays stated that their garbage removal service has been cancelled because Waste Management stated that they would not be able to turn around.  Turek-Shays also commented on the electrical boxes on the east side of their driveway entrance could not be moved.  Gullickson stated that he does not see an issue with the abandonment and that emergency and garbage vehicles would still be able to get into Turek-Shays’ residence.  Stroebel asked how long road has been there.  Turek-Shays replied with 50years.  Stroebel stated that the landowners should get together to get easement for the rest of the road.  Traynors stated that the rocks in question will be moved in approximately one week.  Stroebel suggested that if abandonment is granted that the leaning tress should be removed for truck clearance.  Gullickson suggested that the Turek-Shays and the rest of the residents on the road get together and abandon the rest of Prospect Avenue and the right of way.  Gullickson asked if there were any other questions or concerns.  None heard.  Turek-Shays reiterated their issues and also what would happen if the portion of abandonment was granted.

 

Traynors have the right to place a fence on their property at the end of the abandonment.

Traynors will have rocks removed in approximately one week.

The right of way on the southwest side of road and the east side of Traynors property on Lot 1 CSM #5944 will remain clear so garbage and emergency vehicles can turn around.

Leaning trees would have to be removed from remaining right of way.

 

Board members reconvened.  Motion made by Gullickson/Mork to approve Resolution to Discontinue Portion of Town Road, Resolution No. 2017-01.  Carried-unanimously.

 

Approval of Special Board Minutes:  Motion made by Stroebel/Gullickson to approve the October 11, 2017, Special Board minutes to abandon a portion of Prospect Avenue as submitted.  Carried-unanimously.  

 

Adjourn:  Motion made by Mork/Stroebel to adjourn meeting, 2:33 pm.  Carried-unanimously.
